Article 1 – General
The following articles set out the Terms and Conditions of the Jeanne Bucher Jaeger Gallery within its website https://www.jeannebucherjaeger.com. Jeanne Bucher Jaeger is a simplified joint-stock company with a capital of 213.000 euros, whose head office is located at 5, rue de Saintonge – 75003 Paris and which is registered in the Paris Trade & Companies Register under number 302 696 745 (RCS Paris).
Article 2 – Terminology
The services offered by the website https://www.jeannebucherjaeger.com, namely the sale of their products, will be called hereafter the « products » ; any person wishing to benefit from the products and having complied with these Terms and Conditions will be called hereafter a « client » ; any order made by a client according to the present Conditions will then be described as an « order ».
Article 3 –Products
The products are printed in limited edition.
The presentation pictures of the products are not contractual and the Jeanne Bucher Jaeger Gallery shall not be held responsible if a product did not exactly match the expectations of the client.
The information mentioned on each product sheet and the picture of the product are given for information purposes only and if this does contain errors, the Jeanne Bucher Jaeger Gallery shall not be liable.
Article 4 – Modalities of ordering and price
Visitors of the website https://www.jeannebucherjaeger.com will have the possibility to add the products in a shopping cart and order them directly online.
Whichever payment method is chosen, the client guarantees that he has full authorization to use it and that this payment method gives access to funds that are sufficient to cover any cost resulting from the use of the services offered by https://www.jeannebucherjaeger.com. Only the persons legally capable of signing contracts concerning the products offered on the site can order on the site https://www.jeannebucherjaeger.com
By clicking « Order » during the ordering process, the client declares thorough and unreserved acceptance of the present Terms and Conditions.
The data recorded by https://www.jeannebucherjaeger.com constitute proof of all the transactions made between the company Jeanne Bucher Jaeger and the clients. Once an order has been made via the website, the company Jeanne Bucher Jaeger confirms the order and the shipment to the client by email provided that a valid email address has been indicated by the client during the order.
Contractual information are presented in French language.
All product prices are indicated in Euros, all taxes included, but excluding the costs of processing, shipping and delivery.
When ordering from a country other than France, the client is considered the importer of the concerned products. If customs duties, local taxes or import duties are payable, these rights are the responsability of the client and under their full responsability, both in terms of declarations and payments to the authorities and competent bodies. It is the client’s responsibility to check with the relevant authorities.
The company Jeanne Bucher Jaeger reserves the right to modify the prices at any moment but the articles will be invoiced on the basis of the prices in force at the moment of the order.
The company Jeanne Bucher Jaeger reserves the right to refuse any order placed by a client with whom there is a dispute.
Article 5 – Avaibility
The company Jeanne Bucher Jaeger will do their utmost to handle all the orders subject to stock availability. In case of the unavailability of a product after the ordering process, the client will be informed by email or by phone of partial delivery or cancellation of the order. A substitution of the unavailable product can be proposed to the client. The client will then have 48 hours (working days) to ask for the cancellation or the shipment at specific conditions (partial delivery or substitution product) of their order by contacting the Customer Service by email on firstname.lastname@example.org. After this period of 48 hours (working days) and if the client has not contacted the Customer Service, the company Jeanne Bucher Jaeger will take account of the cancellation of the order and/or, where required, will proceed to the partial shipping of the order to the client.
If the payment has already been debited at the time of information given on product unavailability, a refund action of the amount concerned will be engaged and an e-mail will be sent to the client concerning the subject. Repayment shall be made within 2 weeks, depending on the bank concerned. This period may be extended by 2 additional weeks in case of a foreign bank account.
Article 6 – Payment
The total price of the order is due on the day the order is made by the client.
Payment may be made by credit card or via Paypal. The client accesses a dedicated space provided by a banking institution, which provides security and recording of the payment order. To this effect, the client expressively authorizes the Jeanne Bucher Jaeger Gallery to debit their account accordingly to the amount of the ordered products.
Data recorded by the payment system constitute proof of the financial transactions.
The order will be considered effective upon confirmation of the bank’s agreement to debit the client’s bank account. In case of the bank’s refusal, the order will automatically be cancelled.
In accordance with the law, the client has the right to access and correct data relating to them, which can be exercised by contacting the Gallery.
Article 7 – Reservation of ownership
Until full payment of all outstanding accounts due to the seller from the client, the products supplied shall remain the property of the seller, whatever the payment method may be.
Non-fulfillment by the client of the obligations for payment, whatever the cause, confers to the company Jeanne Bucher Jaeger the right to require the immediate restitution of the delivered products, at expenses, risks and responsibility of the client.
Nevertheless, during the period between delivery and transfer of property, the risks of loss, theft or destruction are chargeable to the client.
Article 8 – Delivery
Delivery is made to the delivery address specified by the client. The delivery may not be performed either in hotels or PO boxes.
To ensure the respect of the delivery schedule, the client is responsible for giving exact and complete information (number of street, building, stair, any access code, name and/or number of the intercom, etc.).
The order will be delivered during the time slot provided to the client by the delivery agent.
In case of absence during the delivery, the client shall have to contact the carrier to agree upon a second delivery date.
The processing and shipping costs are all taxes included. Once the complete order has been shipped, the compagny Jeanne Bucher Jaeger will provide an original invoice including the shipping charges and the VAT.
For each product, a delivery time is indicated on the website.
The delivery times indicated on the order form and on the website are only given for information purposes and relate to the processing schedule of the order, to which the transportation time shall be added. Timeframes may also vary according to the destination and do not include statutory holidays as well as weekends.
Each delivery is considered carried out as soon as the product has been put at the client’s disposal by the carrier, materialized by the control system used by the carrier. The client should survey any expedition on arrival, and make any reservation and claims that appear to be justified, or even refuse the parcel, if it may have been opened, or if it shows visible traces of damage. The aforementioned reservations and any complaint must be sent to the company Jeanne Bucher Jaeger by registered letter with acknowledgement of receipt in three (3) working days following the delivery of the products.

Article 9 – Right of cancellation
The client has the right to cancel the purchase under the terms of article L.121 21 of the Code of Consumption, for a period of 14 days as from the date of reception of the order. The client will have the right to return the product to the Jeanne Bucher Jaeger Gallery – 5, rue de Saintonge – 75003 Paris. The reimbursement will be made by cheque or by transfer payment within 14 days starting from the date of receipt of the products by the company Jeanne Bucher Jaeger, in accordance with the cancellation rights.
The cancellation right can also be carried out from order and before delivery. In this case, the order is cancelled et the company Jeanne Bucher Jaeger will inform its bank.
In accordance with the cancellation right, the product(s) must without fail be returned in their original packaging with a copy of the invoice. Any large item must be packed in the same way as the original delivery, on pallet where applicable.
The costs and risks of the return of the product(s) are assumed by the buyer. Any returned product will give right to a refund equal to the purchase price of the product(s) acquired.
Article 10 – Guarantee
If the products do not conform to the information given during the presentation of the products on the site or have hidden defects, they will be replaced or refunded depending on the availability of similar products and the willingness of the client.
The company Jeanne Bucher Jaeger shall be informed by e-mail within 48 hours. Any return must be sent within 14 days, the date shown on the delivery note evidencing the date of delivery.
All warranty is excluded in case of defects from exterior events, accidents, especially electrical accidents, wear and tear, installation and non-conform use with the instructions provided.
All returns must be authorized by the company Jeanne Bucher Jaeger with the award of a return number. The client must thus make a written request to the company Jeanne Bucher Jaeger.
Any product must without fail be returned in their original packaging. All product that will have been damaged, or whose original packaging will have been damaged, cannot be refunded or exchanged. Refund will be made in the same way of payment used by the client within 30 days.
For all shipping to countries of the European Union, the return fees will only be covered in cases of non-compliance, damages or reference error.
Article 11 – Intellectual property
All products for sale by the Jeanne Bucher Jaeger Gallery are protected by copyright. Buying an original does not confer on the client any right to produce any image or reproduction, to publish or submit for publication, or exhibit the artwork to any third party for any purpose without written consent from the author.
All rights for explanatory texts, illustrations and photographs on the Jeanne Bucher Jaeger Gallery’s website are reserved worldwide under copyright and intellectual property.
Any full or partial reproduction of the Jeanne Bucher Jaeger Gallery’s website is strictly prohibited.
Article 12 – Responsibility – Disputes – Governing law
The company Jeanne Bucher Jaeger shall not be held liable for any loss or damage, whether material, immaterial or corporal, which may result from a poor functioning or inadequate use.
The responsibility of the company Jeanne Bucher Jaeger will be limited, in any case, to the amount of the order and shall not be questioned for simple errors or omissions which may have remained in spite of all the precautions taken in the presentation of the products.
The company Jeanne Bucher Jaeger shall not be held responsible for the non-performance of the contract in case of unavailability or out-of-stock condition of the product(s), in case of force majeure, disturbance or strike in particular of postal and transport services and/or communications, flood, fire.
In the case of litigation, the client should first contact the company Jeanne Bucher Jaeger to try and obtain an amicable solution. Failing that, the Paris courts are the only competent courts, wherever the delivery places and whatever the means of payment may be.
These Terms and Conditions shall be governed by and construed in accordance with the French law. Any dispute relating to the interpretation or implementation of these Terms and Conditions shall be submitted to the exclusive jurisdiction of the Paris Courts.
Article 13 – Confidentiality
The company Jeanne Bucher Jaeger shall not disclose to any third parties any of the information provided by their clients on their website. They are confidential and will only be used by their internal departments for processing orders and to enhance and customize communication including letters / information e-mails but also to customize the website according to the users’ preferences.
The company Jeanne Bucher Jaeger therefore shall not sell, market or rent out information on their clients to any third parties.
The company Jeanne Bucher Jaeger may provide aggregated statistics about clients, sales, trading patterns and related site information to reputable third parties but these statistics will include no personal data.
The present article can not hinder a cease of business activities or of a business transfer. In accordance with the French “Loi Informatique et Libertés” (the law on data protection and civil liberties) of 6 January 1978, the client has the right at all times to access, correct or object to all his personal information by sending a letter about this, including proof of his identity, to the Company Jeanne Bucher Jaeger – 5, rue de Saintonge – 75003 Paris.
Article 14 – Miscellaneous
The company Jeanne Bucher Jaeger reserves the right to modify the present general conditions without prior notice. The clients who would not wish that the contractual relations are governed by the new version of the general conditions of sale, will have to notify it and, as from the date from which the new version will come into effect, they will have to stop using the https://www.jeannebucherjaeger.com services.
If one or more provisions of these Terms and Conditions are held to be invalid or declared as such under any law, regulation or final decision of a competent court, other provisions shall remain in full force and scope.
The fact that one of the parties does not apply, at any time, any of the provisions of the present general conditions or does not request the application thereof by the other party shall not be considered as constituting a waiver of any such provision or of any other provision, or affecting the validity of these conditions, or the right of each party to subsequently claim the application of such provision or of the conditions themselves.
